This agreement is entered into by and between you ("User") and the operator of Vivi.AI ("Service provider"), and has the force of law.

Please read this agreement carefully before using the Vivi.AI application or website. This agreement constitutes a legal agreement between you and the Company regarding the use of this Application and supersedes any previous relevant agreements.

If you do not agree to any of the terms of this agreement, please immediately stop using the Application. Continued use indicates your acceptance of all the terms of this agreement.

I. General Provisions

• Functions and Services: This Application mainly provides AI-based conversation and communication services, and users can interact with virtual characters.
• Rights and Obligations of Users: Users have the right to use the services of this Application and are responsible for their actions on this Application. Users shall abide by laws and regulations, not infringe upon the rights of others, not submit malicious code or viruses, and ensure that they are over 18 years old.
• Rules of Use of Services: When using this Application, users shall not post illegal information or abuse the services.

II. Intellectual Property

• Ownership of User-Generated Content: The content generated by users in this Application belongs to the users, but the users grant the Company the right to use, distribute, and display such content.
• Ownership of AI-Generated Content: The content generated by AI belongs to the Company, and users can use it within this Application, but not for commercial redistribution.
• Protection of Intellectual Property: Users shall not infringe upon the intellectual property rights of the Company or other third parties.

III. Disclaimer

• Disclaimer of Application Performance: The Company endeavors to provide stable, reliable, and accurate services, but does not guarantee the performance, reliability, accuracy, etc. of this Application.
• Disclaimer of User-Generated Content: The Company does not assume any responsibility for the content generated by users, including but not limited to the authenticity, legality, accuracy, etc. of the content.
• Disclaimer of AI-Generated Content: The content generated when users interact with AI may be automatically generated by AI, not real human conversations. Users should maintain rational and critical thinking about AI-generated content and not blindly believe or rely on it.
• Disclaimer of Third-Party Links and Content: This Application may contain third-party links and content, and the Company does not assume any responsibility for these third-party links and content.

IV. Limitation of Liability

This application is committed to protecting users' privacy. However, under any circumstances, the company shall not be liable for any direct, indirect, special, accidental or consequential losses arising from or related to the use of this application, including but not limited to losses caused by data leakage, loss of business opportunities, damage to reputation, etc., unless such losses are caused by the company's intentional or grossly negligent acts.

The company shall also not be liable for privacy-related issues caused by force majeure, acts of third parties, users' own acts or other unforeseeable and unavoidable events.

Users clearly understand and agree that in the process of using this application, they should bear the responsibility for protecting personal privacy on their own and take appropriate security measures. The company shall not be liable for losses caused by users' failure to properly protect personal information.

The interpretation, execution and dispute resolution of this privacy agreement shall be governed by the laws of the Hong Kong Special Administrative Region.

V. Processing of User Data

By using this Application, you agree to our Privacy Policy, which forms part of this agreement. Please refer to the Privacy Policy to understand how we collect and process your personal information.

VI. Changes and Termination of Services

The Company may change or terminate the services of this Application at any time, including but not limited to adding, deleting, modifying service content, suspending or terminating services, etc. The Company will notify users before changing or terminating the services. Users have the right to stop using this Application before the services are changed or terminated.

VII. Update of User Agreement

The Company reserves the right to update this agreement at any time, and the updated agreement will be posted in this Application. Continued use of this Application indicates your acceptance of the updated agreement.
